Review the Notice of Allowance

We begin with the serial number, Notice of Allowance date, goods or services, and any extension history. This identifies the use-related filing stage and the information needed from you.

Prepare real use evidence

Provide dates of use and genuine examples showing the mark used for the relevant goods or services. Product labels, packaging, or qualifying service material need to reflect the real activity being claimed.

File the use statement or review an extension

The initial period is generally six months from the Notice of Allowance. Eligible applicants can request successive six-month extensions, up to five in total. The record determines which step is available; acceptance of the use filing is decided by the USPTO.

Questions about this service

What if I have not started using the mark?

Discuss whether an extension request is available before the current period ends. Do not claim use that has not occurred.

Can I submit a mockup?

A specimen must show qualifying actual use. A design mockup or digitally created product image does not establish that use.

What if I receive an Office Action afterward?

Use our Statement of Use Office Action service for a review of the letter, the filed evidence, and the remaining requirements.
