USA Trademarks Expert (a brand owned and operated by EASY RESEARCHER LLC)

These Terms of Service (“Terms”) govern your access to and use of the website located at https://usatrademarksexpert.com (the “Site”) and the services provided by EASY RESEARCHER LLC, operating under the brand USA Trademarks Expert (“USA Trademarks Expert,” “we,” “us,” or “our”), including trademark search, registration, renewal, monitoring, and office action response services, as well as company formation/business setup support and Amazon Brand Registry assistance (collectively, the “Services”).

By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

1. Nature of Our Services; No Attorney-Client Relationship

USA Trademarks Expert, a brand of EASY RESEARCHER LLC, provides trademark filing-assistance and brand-protection support, including preparation and submission of applications to the United States Patent and Trademark Office (USPTO) and international bodies where applicable. We also offer company formation/business setup assistance and Amazon Brand Registry support. Where these Terms refer to filings and registrations, they apply correspondingly to the relevant authority or platform (e.g., state formation agencies or Amazon).

Unless you have entered into a separate, signed engagement agreement expressly establishing legal representation, USA Trademarks Expert is not acting as your attorney, and no attorney-client relationship is created by your use of the Site or Services. Information provided on the Site or by our staff is for general informational purposes and is not legal advice. For legal advice specific to your situation, consult a licensed attorney.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. Your Responsibilities

You agree to:

Provide accurate, current, and complete information, including regarding your brand, mark, and the goods or services associated with it;
Promptly respond to requests for information needed to process your filing;
Review all documents and information before submission; and
Use the Services only for lawful purposes and in compliance with these Terms and applicable law.

You are responsible for the accuracy of the information you submit. Errors, omissions, or misrepresentations in the information you provide may affect the outcome of your filing.

4. Fees, Government Costs, and Payment

Our service fees are stated on the Site or in your order. Government filing fees (such as USPTO fees) are separate from our service fees and are the responsibility of the client, as indicated in our pricing. Government fees are set by the applicable authority and are subject to change.

Payment is due at the time of order unless otherwise agreed. All fees are quoted in U.S. dollars. You authorize us to charge your provided payment method for the amounts due.

5. No Guarantee of Registration

Trademark registration is decided solely by the USPTO or the relevant governmental authority based on legal standards, existing marks, and other factors outside our control. We do not and cannot guarantee that any application will be approved or that a mark will be registered. Any references to “satisfaction guarantee,” “approval guarantee,” or similar terms refer to our service commitments as described for the applicable package and do not override the discretion of the USPTO or other authorities. Government filing fees are generally non-refundable by the government regardless of outcome.

6. Refunds and Cancellations

Refund eligibility, if any, is governed by the refund terms applicable to your specific package or order. Government filing fees, and work already performed, may be non-refundable. To request a cancellation or refund, contact us at info@usatrademarksexpert.com. We will handle requests in accordance with the applicable package terms and law.

7. Turnaround Times

Any estimated timelines are approximate. Processing times depend on the USPTO or other authorities, the completeness of the information you provide, and other factors outside our control. We are not liable for delays caused by third parties or government backlogs.

8. Communications and Consent

By providing your contact information, you agree that we may contact you by email, phone, and – where you have opted in – SMS/text message regarding your order and our Services. SMS practices are described in our Privacy Policy. You may opt out of text messages at any time by replying STOP. Message and data rates may apply. Consent to marketing messages is not a condition of purchase.

9. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is owned by or licensed to EASY RESEARCHER LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site content without our prior written permission. We do not warrant that the Site will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by law, EASY RESEARCHER LLC and its brand USA Trademarks Expert, and their officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or relating to your use of the Site or Services. Our total aggregate liability for any claim relating to the Services will not exceed the amount of service fees you paid to us for the specific order giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless EASY RESEARCHER LLC and its brand USA Trademarks Expert from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party, including any claim that a mark you submitted infringes another party’s rights.
